    Supreme court issues a notice to Gotabaya

    The Supreme Court has issued a notice to former President Gotabhaya Rajapaksa today.

    That is to state facts regarding the release of Army Sergeant Sunil Ratnayake, who had been sentenced to death by the Colombo High Court, on a presidential pardon.

    This order was issued after consideration of a fundamental rights petition filed by Mr. Pakyasothi Saravanamuthu, Executive Director of Alternative Policy Centre.

    When the petition was called today, Mr. MA Sumanthiran, the President’s lawyer who appeared on behalf of the petitioner, asked former President Gotabaya Rajapaksa and Army Sergeant Sunil Rathnayake to present their facts before the court and said to allow the issuance of notices.

    Accepting that request, the Supreme Court bench has ordered to issue a notice to former President Gotabhaya Rajapaksa asking him to submit his facts regarding the granting of presidential pardon to the accused.

    The High Court had sentenced Sergeant Sunil Ratnayake to death in connection with the killing of eight displaced civilians, including a 5-year-old child, in Mirusuvil area of Jaffna.

    Then Mr. Sunil Ratnayake filed an appeal to the Supreme Court asking to be acquitted from the death penalty.

    The five-judge bench that considered the petition had also upheld the High Court decision.
